Aya (“App”, “Service”) is provided by Raphaël De Oliveira (“we”, “us”, “our”). These Terms of Use and Privacy Policy (collectively, the “Terms”) govern your access to and use of Aya’s mobile applications and website.
By accessing or using Aya, you agree to these Terms. If you do not agree, do not use the Service.
Part A — Terms of Use
1 - Who We Are
Aya is an AI-powered stylist and virtual try-on app that helps you organize your wardrobe, generate outfit ideas, preview looks, and share content with others.
2 - Eligibility & Account
- You must be legally capable of entering into a binding agreement and meet the minimum age of digital consent in your country (e.g., 13–16 in the EU; 13 in the US). If you are under the age of digital consent, your parent or legal guardian must accept these Terms on your behalf.
- Account creation is personal. Do not share, sell, lend, or transfer your account. You are responsible for the security of your device and all activity on your account.
- We may suspend or terminate accounts for suspected abuse, fraud, or breach of these Terms.
3 - User-Generated Content (UGC) & Moderation
- You may upload or create images, captions, and other content. You retain ownership of your UGC, but grant us a worldwide, non-exclusive license to host, process, display, and transmit your UGC solely to provide the Service.
- You must not submit content that is illegal, harmful, hateful, harassing, exploitative, pornographic, infringing, or that violates another’s rights.
- We may remove content or restrict accounts to protect users or enforce these Terms. You can report violations inside the app.
4 - Acceptable Use
Do not:
- Reverse engineer, scrape, or misuse the Service.
- Upload malicious code or interfere with our systems.
- Use the Service to violate any law or third-party right.
5 - Virtual Try-On, Camera & Media
The App may access photos or videos that you voluntarily select in order to provide AI-powered features such as virtual try-on, image generation, image editing, face animation, lip synchronization, scene transformation, and video generation.
Media selected for an AI feature is securely transmitted to our cloud infrastructure and, where required to perform the requested feature, to the AI service providers identified in this Privacy Policy. Source media is processed only to provide the feature requested by you. Generated content may be stored in your private Aya account so that you can access, download, or delete it.
6 - Location, Notifications & Voice Features
Location: may be used to tailor suggestions (e.g., weather-aware outfits).
Notifications: may alert you about account activity, rewards, offers, or updates. You can change preferences in system settings.
Voice features: may help with dictation or commands. You can disable microphone access in system settings.
7 - AI Suggestions & Disclaimers
AI outputs are probabilistic and may be inaccurate or unsuitable. Use your own judgment. We are not responsible for decisions you make based on suggestions. The App does not replace professional advice.
8 - Intellectual Property
- The Service (excluding your UGC) is owned by us and our licensors.
- You may not use Aya marks, UI, models, or assets except as allowed by these Terms.
9 - Subscriptions, Pricing & Free Trials
We offer free and paid plans (for example, Basic and Premium). Details, benefits and limits are shown in-app.
Auto-Renewals.
Paid subscriptions renew automatically at the end of each period until canceled. You can cancel at any time in your platform account settings (Apple App Store / Google Play). Cancellation takes effect at the end of the current period.
Trials & Intro Offers.
If you start with a trial or introductory price, you will be charged the standard price when the offer ends unless you cancel before renewal. Eligibility for offers may vary by region and platform.
Price & Plan Changes.
We may modify plan names, features, and prices. We will provide notice in-app or via your platform before changes take effect. New prices apply only on your next billing cycle (renewal) or when you switch plans, unless a different effective date is explicitly stated. Existing subscribers keep their current price and features until the end of the already-paid period.
Taxes.
Prices may exclude taxes and fees. Applicable taxes are added as required by law.
Billing Channel.
Payments, renewals, refunds, and cancellations are handled by the platform provider (Apple / Google). Please review your store’s terms. We do not issue refunds directly except where required by law.
Manage & Restore Purchases.
You can manage or restore purchases using the platform features provided in-app.
10 - Virtual Coins/Credits & One-Time Purchases
We may offer virtual coins/credits or one-time packs usable for specific features (e.g., additional generations, downloads, or slots). Coins/credits have no cash value, are non-transferable, and are subject to expiration or change. All purchases are final to the fullest extent permitted by law and the platform’s policies.
11 - Third-Party Services
Aya integrates third-party services (e.g., Apple/Google billing, analytics, authentication, cloud services, notifications). Your use of those services may be subject to their own terms and privacy policies.
12 - Termination
We may suspend or terminate access for any breach of these Terms, unlawful conduct, or risk to other users. You may stop using the Service at any time and can request deletion of your account data as described in the Privacy Policy.
13 - Warranty Disclaimer & Limitation of Liability
The Service is provided “as is” without warranties of any kind. To the maximum extent permitted by law, we are not liable for indirect, incidental, punitive, or consequential damages, or for loss of data, opportunities, or profits. Our aggregate liability arising out of or relating to the Service will not exceed the amounts you have paid to us in the 12 months before the event giving rise to the claim.
14 - Changes to These Terms
We may update these Terms from time to time. We will post the updated version and, where required, notify you before changes take effect. Continued use after the effective date constitutes acceptance.

Part B — Privacy Policy
1 - Scope & Controller
This Privacy Policy explains how we collect, use, and share information when you use Aya’s mobile app and website. The data controller is Raphaël De Oliveira (contact: contact@ayavogue.com).
2 - Information We Collect
We aim to collect only what’s necessary to operate and improve the Service.
- Account & Profile: name, email, authentication IDs; subscription status and plan metadata.
- Device & Usage: app version, device type, language, approximate region, interactions with screens and features, crash and performance data.
- Purchases: purchase tokens, product IDs, and status (e.g., trial/active/canceled) from Apple/Google to deliver entitlements. We do not receive your full payment card details.
- Photos, Videos, Face Data and Generated Media: photos and videos that you voluntarily select, capture, or upload when using features such as virtual try-on, image generation, image editing, scene transformation, face animation, lip synchronization, talking-photo features, and video generation. These files may contain a visible human face and are therefore treated as face data for the purposes of this Privacy Policy. We also process the prompts, settings, masks, reference images, and generated results associated with your request.
- Location (optional): approximate location to tailor suggestions (e.g., weather-aware styling). You can disable location permissions at any time.
- Notifications & Identifiers: push token/device identifier for delivering notifications you opt into.
- Voice/Microphone (optional): audio you speak for dictation or controls. We do not retain raw audio after processing.
- Contacts (optional): if you choose to share with contacts, access is used only to complete your action. Contact data is not stored on our servers.
3 - Face Data and AI Media Processing
Face Data We Process
Some Aya features process photos or videos containing a human face. This may include the visible facial image, facial position, expression, orientation, and other visual characteristics necessary to produce the image or video transformation requested by the user.
Aya does not use face data to identify or authenticate individuals. We do not perform facial recognition, determine a person's identity, create biometric identifiers or faceprints, compare faces against databases, or use face data for surveillance, advertising, tracking, profiling, or eligibility decisions.
How Face Data Is Collected
Face data is collected only when the user voluntarily selects, captures, or uploads a photo or video and chooses to use an AI-powered feature. Aya does not continuously scan the user's photo library, camera, or device. Access is limited to the media selected by the user or captured after the user grants the relevant system permission.
Purposes of Face Data Processing
Face data may be processed only for the following purposes:
- generating or editing an image requested by the user;
- providing virtual try-on and fashion visualization;
- animating a photo or generating a video from a photo;
- providing lip synchronization, talking-photo, facial-expression, movement, zoom, scene-swap, or similar creative effects;
- maintaining the visual consistency of the person in the generated result;
- detecting technical failures, misuse, or content that violates applicable safety requirements; and
- delivering, storing, and displaying the generated result in the user's private account.
We do not sell face data. We do not use face data for advertising, cross-app tracking, facial recognition, biometric identification, or the creation of user profiles. We do not use user face data to independently train Aya models.
Disclosure to AI Service Providers
To perform the AI feature requested by the user, selected photos, videos, prompts, and related generation parameters may be securely transmitted to Google Cloud, including Google Cloud Vertex AI and its image or video generation services. Google acts as a service provider and data processor on our behalf for these operations.
Depending on the feature selected, the information transmitted may include:
- the photo or video selected by the user;
- visible face data contained in that media;
- text prompts and editing instructions;
- masks, reference images, style selections, and generation settings; and
- technical request identifiers required to process and return the result.
This information is disclosed only for the purpose of completing the generation or transformation requested by the user. Our service providers are contractually required to process this information only on our instructions, apply appropriate security safeguards, and provide the same or an equivalent level of protection as described in this Privacy Policy.
Face Data Storage and Retention
Source photos and videos submitted for AI processing are retained only for the limited time technically necessary to upload the media, perform the requested generation, return the result, address temporary processing failures, and protect the security of the Service. Source media is not retained as a biometric profile or face template.
Temporary source media is deleted from Aya-controlled processing storage after the generation process is completed and, in all cases, within 24 hours, unless a longer period is required to complete a user-requested retry, investigate abuse or security incidents, comply with law, or resolve a support request initiated by the user.
AI providers may temporarily process or retain request data according to the enterprise service terms applicable to our account. We require any provider receiving face data to provide the same or equivalent protection described in this Privacy Policy and not to use the data for unrelated purposes.
Generated images and videos that the user chooses to save may be stored in the user's private Aya account until the user deletes the content, deletes the account, or requests deletion. Generated content is accessible only to the authenticated user, except when the user deliberately publishes or shares it through a community or sharing feature.
Deletion of Face Data
Users can delete saved generated images and videos using the deletion controls available in the App. Deleting content removes it from the user's account and schedules the associated stored file and metadata for deletion from our active systems.
Users may also delete their Aya account from the App or request deletion by contacting contact@ayavogue.com. Account deletion includes deletion or irreversible de-identification of stored source media, face data, generated private media, and associated account metadata, except information that we are legally required to retain.
Withdrawal of Consent
AI media and face-data processing is based on the user's explicit permission. A user may withdraw permission at any time by:
- not submitting additional photos or videos for AI processing;
- revoking Photos or Camera permission in the device settings;
- using the App's privacy or AI-processing controls, where available;
- deleting previously generated content;
- deleting the Aya account; or
- contacting contact@ayavogue.com.
Withdrawing consent does not affect processing already completed before consent was withdrawn. After withdrawal, Aya will not process new face data unless the user provides permission again by knowingly initiating another AI feature.
4 - How We Use Information
- Provide, secure, and maintain the Service and your entitlements (e.g., access to paid features).
- Personalize experiences (e.g., suggested outfits, try-on options, language/localization).
- Communicate with you about changes, offers, rewards, and support.
- Monitor performance, fix bugs, and improve features.
- Comply with legal obligations and enforce our Terms.
5 - Legal Bases (EEA/UK)
We rely on: (i) contract (to provide the Service); (ii) legitimate interests (e.g., safety, fraud prevention, analytics); (iii) consent (e.g., push notifications, location, marketing); and (iv) legal obligation.
6 - Sharing of Information
We share information only as needed to operate the Service or as required by law:
- Google Cloud and Google Cloud Vertex AI: selected photos, videos, visible face data contained in that media, prompts, reference images, generation parameters, and technical request identifiers may be transmitted to Google Cloud to provide the image and video generation or transformation requested by the user.
- Firebase and Google Cloud Infrastructure: account information, private generated content, technical logs, authentication information, and application data may be processed to provide authentication, databases, cloud functions, private storage, notifications, security, and application hosting.
- Equivalent Protection: any processor or third party receiving face data or personal media on our behalf must provide the same or an equivalent level of privacy, security, retention, use limitation, and deletion protection described in this Privacy Policy.
- Platform Providers (Apple App Store / Google Play) for purchases, refunds, and entitlements.
- Law & Safety when necessary to comply with legal requests or protect rights.
- Business Transfers in case of merger, acquisition, or asset sale.
7 - International Transfers
Our vendors may process data outside your country (including outside the EEA/UK). Where required, we use appropriate safeguards (e.g., Standard Contractual Clauses).
8 - Data Retention
We retain each category of information only for as long as necessary for the purpose for which it was collected:
- temporary source photos, videos, and face data submitted for AI processing: for the duration of processing and no longer than 24 hours, subject to the limited exceptions described in the Face Data section;
- saved generated images and videos: until the user deletes the content or deletes the account;
- account and profile information: for the duration of the account and until account deletion is completed;
- purchase and transaction records: for the period required by applicable accounting, tax, fraud-prevention, and legal obligations;
- security and technical logs: for a limited period appropriate to security, debugging, abuse prevention, and legal requirements.
Following a valid deletion request, data is deleted from active systems or irreversibly de-identified. Residual encrypted backup copies may remain for a limited backup rotation period and are not restored except for disaster recovery, security, or legal purposes.
9 - Your Rights
Depending on your location, you may have rights to access, correct, delete, restrict, or object to processing of your personal data, as well as data portability and the right to withdraw consent. You also have the right to lodge a complaint with your local data protection authority (for example, CNIL in France). To exercise rights, contact contact@ayavogue.com.
10 - Children’s Privacy
Aya is not directed to children under the age of digital consent in their jurisdiction. We do not knowingly collect personal data from such children. If you believe a child has provided us data, contact us to request deletion.
11 - Security
We use technical and organizational measures appropriate to the risk (e.g., authentication, encrypted transport, access controls). No system is 100% secure; keep your device and account credentials safe.
12 - Cookies & Local Storage
The mobile app uses device storage for preferences and cached data. The website may use cookies or similar technologies for essential functionality, analytics, and localization. You can control cookies through your browser settings.
13 - Changes to This Policy
We may update this Privacy Policy periodically. Material changes will be notified in-app or on our site before they take effect.

Appendix — Region-Specific Disclosures
- EEA/UK: You have the rights listed in Section 9. Our legal bases are set out in Section 5. We rely on safeguards for international transfers (Section 7).
- California: We do not sell or share personal information as defined by the CCPA/CPRA. You may request access and deletion as described in Section 9.
